ZONING ORDINANCE

An Ordinance of the City of Clute Establishing Comprehensive Zoning Regulations for the City of Clute, Texas, and Providing for the Administration, Enforcement, and Amendment Thereto in Accordance With the Provisions of V.T.C.A., Local Government Code ch. 211; and Establishing Districts and Setting Forth Rules for Every District; Providing Penalties and a Savings Clause.

Whereas, the Zoning Enabling Act adopted as V.T.C.A., Local Government Code ch. 211, and all amendments thereto and amendments which may hereafter be made thereto, and hereinafter called the act, and referred to either wholly or in part and article 14, Home Rule Charter of the City of Clute, Texas, which empowers the city to enact a zoning ordinance and to provide for its administration, enforcement and amendments; and

Whereas, the city council deems it necessary for the purpose of promoting the health, safety, morals and the general welfare of the city to enact such an ordinance; and

Whereas, the city council, pursuant to the provisions of the act, has appointed a zoning commission to recommend the boundaries of the various original districts and appropriate regulations to be enforced therein; and

Whereas, the zoning commission has divided the city into districts and has prepared regulations pertaining to such districts in accordance with a comprehensive plan and designed to lessen congestion in the streets; to secure safety from fire, panic, and other dangers; to promote health and the general welfare; to provide adequate light and air; to prevent the overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provision of transportation, water, sewage, schools, parks, and other public requirements; and

Whereas, the zoning commission has given reasonable consideration, among other things, to the character of the districts and their peculiar suitability for particular uses, with a view to conserving the value of buildings and encouraging the most appropriate use of land throughout the municipality; and

Whereas, the city council has given due public notice of hearings relating to zoning districts, regulations, and restrictions, and held such public hearings jointly with the zoning commission to consider the preliminary report of the commission; and

Whereas, all requirements of the act with regard to the preparation of the report of the zoning commission and subsequent acts of the city council have been met; and

Whereas, the provisions contained herein regarding flood zoning have been included under the authority of the Flood Control and Insurance Act of the State of Texas, codified as subchapter I of title 2 of the Texas Water Code, being V.T.C.A., Water Code § 16.311 et seq., in order to adopt the mandatory provisions of the National Flood Insurance Act of 1968, as amended, codified as 42 USC 4001 et seq.
