§ 14.04. The planning and zoning commission; powers and duties.

  • The planning and zoning commission shall have the power and duty, and shall be required to:

    (a)

    Make and amend a master plan for the physical development of the city;

    (b)

    Recommend to the city council approval or disapproval of proposed changes in the zoning plan;

    (c)

    Exercise control over the platting or subdividing of land without and within the corporate limits of the city as permitted by law;

    (d)

    Submit annually to the city secretary, for forwarding to the city council, not less than ninety (90) days prior to the beginning of the budget year, a list of recommended capital improvements which in the opinion of the planning and zoning commission are necessary or desirable during the forthcoming five (5) year period;

    (e)

    Require information from the other departments of the city government in relation to its work;

    (f)

    Within its budget appropriation, contract with city planners and other consultants for such services as it may require from time to time;

    (g)

    Draft, and recommend to the city council for adoption, an official map of the city and recommend or disapprove proposed changes in such map;

    (h)

    Make, and recommend to the city council for adoption, a zoning plan and recommend or disapprove proposed changes in such plan;

    (i)

    Make, and recommend to the city council for adoption, plans for the clearance and rebuilding of slum districts and blighted areas which may develop within the corporate limits, or which have heretofore developed within the corporate limits of the city;

    (j)

    Compile, and recommend to the city council for adoption, a building code, which code shall include the minimum standards of construction for buildings, the minimum standards for plumbing, and the minimum standards for wiring;

    (k)

    Meet not less than once each month; such meetings to be held at the city hall unless prior notice of change of meeting place be given by publication in a newspaper of general circulation within the City of Clute;

    (l)

    The city secretary or his representative shall attend the meetings of the planning and zoning commission and shall serve as liaison between the planning and zoning commission and the city council;

    (m)

    The planning and zoning commission shall be responsible to and act as an advisory body to the city council and shall perform such additional duties and exercise such additional powers as may be prescribed by ordinance of the city council not inconsistent with the provisions of this Charter;

    (n)

    Any other powers and duties prescribed by V.T.C.A., Local Government Code chs. 211 and 212, for planning or zoning commissions.
