§ 2.12. Street improvements.

  • The City of Clute shall have the power and exclusive dominion, control and jurisdiction in, upon and over and under the public streets, avenues, alleys and highways of the city, and may provide for improvement thereof by paving, repaving, raising, draining or otherwise, as may be provided by law; and the city shall have the right and power in connection herewith to require the furnishing of adequate railroad crossing signals, street crossing, and other easements at the costs and expense of any such railroad operating within the City of Clute, Brazoria County, Texas; such exclusive dominion, control and jurisdiction in, upon and over and under the public streets, avenues, alleyways and highways of the city shall also include, but not be limited to, the right to regulate, relocate, remove, or prohibit the location of, all utility pipes, lines, wires and other property, and shall further include the power to prohibit movement in and upon such street or alleyway by vehicles whose traveling thereupon tends to damage such street or alleyway.
