§ 78-41. Definitions.

  • The following words, terms and phrases, when used in sections 78-42, 78-43 or 78-44 shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Permanent residence means a place where the person abides, lodges or resides for 14 or more consecutive days.

    Sexual offender means a person who has been convicted by a court of competent jurisdiction of a violation of V.T.C.A., Penal Code §§ 20.04(a)(4), 21.08, 21.11, 22.011, 22.021, 25.02, 30.02(d), 43.25 or 43.26, regardless of whether the adjudication was deferred, in which the victim of the offense was less than 17 years of age, and because of such conviction the person is required to register with local law enforcement for inclusion in the department of public safety sex offender database.

    Temporary residence means a place where the person abides, lodges or resides for a period of 14 or more days, in the aggregate, during any calendar year and which is not the person's permanent address, or a place where the person routinely abides, resides or lodges for a period of four or more consecutive or nonconsecutive days in any month and which is not the person's permanent residence.
