§ 38-38. Commitment and length of confinement.

  • (a)

    All persons committed to the custody of the chief of police by the judge of the municipal court shall be kept by him at the city jail; however, the chief of police shall be authorized to make arrangements with the sheriff and, for this purpose, to incur indebtedness on the part of the city to the sheriff for the keeping of any prisoner committed to the custody of the chief of police when, in his discretion, it would be unsafe to keep such prisoner in the city jail.

    (b)

    Any defendant committed to the custody of the chief of police by the judge of the municipal court after conviction on account of failure to pay the fine, costs of court, if any, and tax assessed shall be discharged after such person has remained in jail a sufficient length of time to satisfy such fine, costs of courts, if any, and tax at the rate of $50.00 per day.
