§ 38-36. Complaint; defenses; burden of proof.

  • A complaint filed in the municipal court is not required to negate the existence of any defense; but if raised by the evidence the prosecution shall have the burden of proof unless it is an affirmative defense, in which case the defendant shall have the burden of proof as provided in V.T.C.A., Penal Code ch. 2.
